Terms and conditions

  1. The Dining Out Gift Card is issued by Mitchells & Butlers Leisure Retail Limited, 27 Fleet St, Birmingham, B3 1JP (registered number 1001181).
  2. Gift cards are available as either plastic gift cards (“Physical Cards”) and digital gift cards (“eGift Cards”) to business customers, together referred to herein as (“The Dining Out Corporate Gift Cards”).
  3. Dining Out Corporate Gift Cards are available in variable denominations for Physical Gift Cards and eGift Cards, and you can choose any denomination between £5 - £250 for Physical Gift Cards and £5 - £250 for eGift Cards. The minimum order value is £1000 for Physical Cards. Orders of Physical Cards of less than £1000 can be made at the Dining Out Gift Card Consumer Site https://www.thediningoutgiftcard.co.uk/about/.
  4. Payment for Dining Out Corporate Gift Cards may be by debit card and credit card (excluding American Express), bank transfer or on account.
  5. Please note: If paying by credit card your bank may treat the purchase of gift cards as a funding transaction that could incur cash advance fees. This decision is at the sole discretion of your credit card provider. Please check your credit card terms and conditions.
  6. Dining Out Corporate Gift Cards can only be purchased by businesses that are registered in the UK and have been approved at registration. Where Dining Out Corporate Gift Cards are to be purchased by credit card, the card must have been issued by a UK and the cardholder’s statement address must be in the UK.
  7. Dining Out Gift Cards can be spent at any Mitchells & Butlers venue in the UK as detailed at https://www.thediningoutgiftcard.co.uk/about/ and subject to the conditions set out below. The Gift Card cannot be used
    • to make any online purchase
    • at any Moto or other Mitchells & Butlers franchise or
    • at any site not managed by Mitchells & Butlers: please check with your server that the Gift Card can be used at the particular site before ordering. Venues can be added and/or removed from the list above at any time at Mitchells & Butlers’ discretion.
  8. Dining Out Corporate Gift Cards can only be sent to valid UK business addresses (excluding PO Boxes) and email addresses. Dining Out Corporate Gift Cards cannot be collected from Mitchells & Butlers venues.
  9. Incomplete order forms will not be processed.
  10. The Dining Out Corporate Gift Card cannot guarantee availability or delivery for bulk purchases.
  11. Once your order has been approved by finance, Physical Gift Cards will be delivered free, via our third-party courier partner, and eGift Cards will be delivered immediately.
  12. Any discrepancies within a delivery of The Dining Out Corporate Gift Cards, should be notified to The Dining Out Gift Card Business Customer Service team as below:

    Discrepancies must be notified prior to activation of the The Dining Out Corporate Gift Cards and within 24 hours of receipt or end of next business day (whichever is the later), after which any discrepancies cannot be investigated or remedied.
  13. Where The Dining Out Corporate Gift Card has any reasonable suspicion of fraud, including but not limited to redemption of Dining Out Corporate Gift Cards that have been reported as missing, it reserves the right to take legal action against the customer.
  14. Dining Out Corporate Gift Cards cannot be refunded or exchanged for cash or credit. The Gift Card is not a cheque guarantee, credit, debit or charge card. No change will be given but the balance can be used multiple times for future purchases until all of the remaining balance is spent.
  15. Physical Gift Cards have no value until activated. Details of how to activate Physical Gift Cards will be included with each delivery. eGift Cards will be activated at the point of ordering. Once activated, Dining Out Corporate Gift Cards are valuable and should be kept secure until required. eGift Cards are valid either presented on a smart phone or printed out. Unused Dining Out Corporate Gift Cards cannot be returned.
  16. Balances on Dining Out Corporate Gift Cards will expire 24 months after the later of the date that any value was last loaded onto the Gift Card, or the date that any value on the Gift Card was last redeemed.   17. Payment in full must be received in advance for all orders, other than those paid for on account, which must have sufficient credit available and be settled within the agreed payment terms. Failure to settle an account on time will lead to the account being frozen and, in some circumstances, removed with the customer placed onto debt management.
  18. Customers applying for a credit account will be subject to a credit check and agree for their information to be passed to a third party for that purpose. The availability of credit accounts is at the discretion of The Dining Out Gift Card and can be revoked at any time, on the giving of notice to the customer.
  19. Settlement terms for all approved accounts is usually fourteen (14) days from the date of invoice or any other time as agreed by The Dining Out Corporate Gift Card, subject to any alternative terms agreed between The Dining Out Corporate Gift Card and individual customers. Customers may forfeit agreed discounted rates and/or agreed credit account facility for failure to meet these terms.
  20. In the event of insolvency, The Dining Out Corporate Gift Card will cancel its contract with you and suspend any further order of The Dining Out Corporate Gift Cards from being placed or delivered without any liability to you. The Dining Out Corporate Gift Card shall also be entitled to de-activate any Dining Out Corporate Gift Cards which have not been paid for.
  21. It is the customer’s responsibility to ensure that The Dining Out Corporate Gift Cards are declared to HM Revenue & Customs where required by law. If you have any queries in relation to this, please contact them directly.
  22. Responsibility for the The Dining Out Corporate Gift Cards passes to the customer at the time of delivery or activation of the cards (whichever is the earlier). The Dining Out Corporate Gift Card has no liability for lost, stolen or damaged cards, whether or not they have been redeemed.
  23. Title in the The Dining Out Corporate Gift Cards remains with The Dining Out until payment has been received in full.
  24. The use by the customer of trademarks or logos of The Dining Out Corporate Gift Card, or any of its trading companies, is only permitted with the prior written consent of Mitchells & Butlers Plc. Requests for such consent should be sent by email to [email protected]. The Dining Out Corporate Gift Card reserves the right to withdraw such consent at any time and for any reason whatsoever, on providing the customer with written notice. The consent will terminate automatically if, in the reasonable opinion of The Dining Out Corporate Gift Card, the customer has breached these terms and conditions or when the customer has used all of its The Dining Out Corporate Gift Cards, whichever is the earlier.
  25. Breach of any of these conditions by the customer entitles The Dining Out Corporate Gift Card to discontinue supply immediately, decline to supply the customer in future and seek any appropriate legal remedy including, but not limited to, damages and / or injunctive relief.
  26. FORCE MAJEURE – The Dining Out Corporate Gift Card do not guarantee delivery of The Dining Out Corporate Gift Cards or the performance of any of its obligations to the customer during any period in which it is prevented or hindered from doing so by reason of any cause beyond its reasonable control. This includes but is not limited to: an act of God, war, riot or civil disturbance, strike, lockout or other labour dispute, fire, flood, drought or accident, legislation, requisitioning or other act or order by any government department, council or duly constituted authority, breakdown of plant or machinery (including transport), shortages or unavailability from normal sources of products or of any other cause (whether of the foregoing classes or not) beyond the reasonable control of The Dining Out Corporate Gift Card.
  27. This contract is governed by the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the English courts.
  28. The Dining Out Corporate Gift Card reserves the right to decline to supply The Dining Out Corporate Gift Cards to any customer recorded on the The Dining Out Corporate Gift Card Blacklist.
  29. The Dining Out Corporate Gift Card reserves the right to change these Terms and Conditions from time to time.
  30. The Dining Out Corporate Gift Card shall at all times comply with the terms of the applicable Data Protection and Privacy laws, instruments or regulations in carrying out its obligations under the terms of these Terms and Conditions.
